Mediation and arbitration proceedings is another arena in which we assist clients in bringing finality to their legal dispute. We explore all avenues of dispute resolution because resolving disputes with minor or no interruption to one’s business or life, is essential.
Mediation
Our attorneys may find it useful for a mediator to be introduced to a dispute. The goal of the mediation process is for a neutral third party to assist disputants to arrive at an agreement on their own rather than imposing or offering a solution. Everyone at the mediation table is subject to confidentiality. The mediator generally works with both sides to explore underlying interests while effectively aiding them to ventilate their respective positions and feelings. This is a cost-effective process with trained mediators available and selected from the High Court Roster.
Arbitration
Where parties opt to utilize arbitration as a means of dispute resolution, a neutral third party serves as a judge who is responsible for resolving the dispute and rendering a legally binding decision and often times confidential decision, which cannot be appealed. The parties to the dispute are free to decide upon any aspect of the arbitration process, including the standard of evidence will be utilized. Like mediation, arbitration tends to be cost-effective and less expensive than litigation.
